Scope of Services & Disclaimer
This page explains what Nick Mirow Coaching does and does not provide, and where the professional boundaries of coaching sit.
1. About this disclaimer
In this disclaimer, "the Client" means a person receiving coaching from Nick Mirow Coaching ("NMC", "the Coach"), and "the Services" means NMC's rowing coaching, training programme design, and athletic development support.
2. What NMC provides
NMC provides rowing coaching, training programme design, and athletic development support. The Services are educational and athletic in nature, helping the Client train, develop technique, build fitness, and work toward their rowing goals.
3. What NMC is not
The Services are not, and are not a substitute for, professional advice in any regulated field. In particular, NMC does not provide:
- medical advice, diagnosis, or treatment;
- physiotherapy or other allied health services;
- registered dietitian or clinical nutrition services;
- psychological, counselling, or mental health services; or
- sports medicine.
NMC is a rowing coach, not a registered health practitioner. Nothing NMC provides should be understood or relied on as advice from a doctor, physiotherapist, dietitian, psychologist, or other registered health professional.
4. General guidance only
During coaching, NMC may give general guidance on nutrition, hydration, recovery, injury management, sleep, and wellbeing as they relate to training and performance. This guidance is general, performance-oriented information only. It is not personalised clinical advice and does not replace advice from a qualified professional.
The Client is encouraged to consult an appropriately qualified professional (a doctor, physiotherapist, accredited practising dietitian, or psychologist) for any medical, injury, clinical nutrition, or mental health matter. If general coaching guidance and a qualified professional's advice ever conflict, the Client should follow the professional's advice.
5. Not a registered health practitioner
NMC does not hold itself out as a registered health practitioner and does not use any title protected under the Health Practitioner Regulation National Law, for example "physiotherapist", "dietitian", "psychologist", or "medical practitioner". NMC's qualifications are in rowing coaching (Rowing Australia accreditation).
6. No guarantee of results
NMC does not guarantee any particular performance result, time, ranking, selection, body weight, or other outcome. Results depend on many factors outside NMC's control, including the Client's training consistency, effort, recovery, genetics, health, life circumstances, and competition conditions.
NMC describes the Services honestly and does not make misleading claims about outcomes, consistent with its obligations under the Australian Consumer Law. Any examples of past athlete results are illustrative only and are not a promise of similar results.
7. Health screening and medical clearance
Before starting the testing battery or any coached training programme, the Client completes a PAR-Q+ health screening at intake.
The Client must obtain medical clearance before starting if they have a pre-existing medical condition, cardiovascular risk factors, or a recent injury, or if the PAR-Q+ indicates clearance is needed.
The Client is responsible for disclosing relevant health information honestly and keeping NMC informed of any change. NMC's coaching and safety guidance rely on the information the Client provides.
8. If you feel unwell
Training is physically demanding. If the Client feels unwell, experiences pain beyond normal training discomfort, or notices any concerning symptom (such as chest pain, dizziness, fainting, or difficulty breathing), they should stop and seek medical advice. In an emergency, call 000.
9. Your consumer law rights
Nothing in this disclaimer excludes, restricts, or modifies any right or guarantee the Client has under the Australian Consumer Law or any other law that cannot lawfully be excluded.
